Who is covered by New York workers’ comp?
Most New York employees are covered from their first day, including part-time workers and many undocumented workers. A few categories – some independent contractors and certain domestic workers – are treated differently.
Why was my claim denied?
Common reasons are a late report, a dispute over whether the injury is work-related, or missing medical evidence. A denied (controverted) claim can be challenged at a hearing before a judge.
How much are my benefits?
Wage benefits are generally two-thirds of your average weekly wage, capped by a state maximum and scaled to your degree of disability. Necessary medical care for the injury should be covered.
Can I be fired for filing?
New York’s Section 120 prohibits firing or punishing you for filing a legitimate claim. Retaliation is a separate violation you can act on.
